Physicians Advised to Avoid Malpractice by not Documenting?

Just noted this at WKOW in Wisconsin.

They have followed up on the developing story of UW Health physicians giving out sick notes without a physical exams. In their report they interviewed David Minko, associate attorney in health care and employment law with Murphy Desmond. He states the following, "Patient records must be created when treating someone. If something wasn't documented, then it did not occur....so, if there was an exam and it wasn't documented, then it did not occur from a malpractice standpoint."

Consider this, I see a patient in the office for a headache, send them home with a get out of work free card and a recommendation to take two aspirin and call me in the morning. If, by chance, they happen to die in the night from a ruptured aneurysm I won't be liable as long as I haven't documented the encounter?

No offense to David Minko, Esq, but I will seek legal counsel elsewhere.
