Hillary Clinton started the problem by using her own personal server, which no previous Secretary of State had done, making her emails clearly under her personal control. That this raises concern about why she chose to do this, and the potential for criminal behaviour is obvious.

"The FBI has begun investigating the security of Hillary Clinton's private e-mail server, an attorney for the Democratic presidential front-runner confirmed to Fox News late Tuesday.
"The probe, which was first reported by The Washington Post, comes days after watchdogs from the State Department and the intelligence community asked the Justice Department to explore whether classified material was improperly shared or stored on the former secretary of state's private e-mail account.
"The Post reports that the FBI has contacted Kendall about the security of a thumb drive he possesses that contain copies of work emails sent by Clinton during her time as America's top diplomat. The paper also reported that the FBI had contacted a Denver-based technology firm that help manage the server."

"Quite predictably, after the [intelligence community's inspector general] made a referral to ensure that materials remain properly stored, the government is seeking assurance about the storage of those materials.
"We are actively cooperating," Hillary Clinton’s lawyer, David Kendall said.
"She did not send nor receive any emails that were marked classified at the time.
"We want to ensure that appropriate procedures are followed as these emails are reviewed while not unduly delaying the release of her emails. We want that to happen as quickly and as transparently as possible," Clinton campaign spokesman Nick Merrill said.
We are a country of laws. The name Clinton does not entitle one to be above the law, albeit the Obama administration does not seem to understand this.
Transparency has an effect on politicians, just like sunlight has on roaches, it makes them scatter. More importantly, if it becomes clear that transparency is the norm, politicians tend to behave better.
And as we have seen, claims of transparency, as Obama has done, mean nothing, and in fact are most frequently a smoke screen, something Obama likely learned from the Clintons.
Given the entire circumstance with the personal server because of her absolute need to control her image, given all of the emails Hillary personally deemed her personal business commingled with State Dept matters, all while parts of the world were imploding under Obama's watch, and given her penchant for dishonestly portraying herself as having no conflict in taking money from governments while Secretary of State, why would anyone believe anything this woman has to say?
I guess only diehard Democrats who after 6+ years of Obama's lies don't give a damn about honesty, credibility or trustworthiness.
Hillary is so humble that when she says that information that she sent in her emails was not marked confidential when she sent them, it never occurred to her that the official communications, including by email, of the Secretary of State of the United States of America are presumed to be confidential and secret until someone says they aren’t, not the other way around.
As Secretary of State of the most powerful country in the world most of Hillary's communications were bound to be classified by their very nature. Add to that that today most communications are by email and you have a massive breach of security.
Are we going to let one get away with a massive breach of security, a breach that continues with her lawyers holding classified documents for which they have no clearance, while the other got punished for a minor one?
We can't let that happen.
The email problem, with Hillary Clinton as well as with her aides, this could be the most dangerous of all the issues with which she’s contending just now. They can’t just destroy them – those emails went to people, and probably not everyone to whom they went can be relied on to destroy their copies.
If Huma Abedin or Jake Sullivan were to destroy their copies and others were to surface, it would be a monumental scandal, in no small part because of the likely content that caused them to destroy them in the first place.
Hence, Philippe Reines turns over his emails only recently, after Hillary’s been two years and more out of office – might have taken that long to track down his correspondents and be sure that what he didn't turn over would not surface.
Contrary to her claims could be the prefix for most of what Hillary has to say. Let's keep following the money trail while she was Secretary of State, funneling money to the Clinton foundation, their money laundering vehicle, and lining up lucrative speaking fees for Hillary, Billy and Chelsea.
